1. What is mediation?

Mediation is the alternative dispute resolution process that helps parties resolve their disputes through negotiation and with the help of a mediator. The decision of the session is not binding on the parties.

2. Can a single college participate in all three competitions?

Yes, three different teams can participate in all three competitions from a single college.

3. Will other teams be allowed in the hall during the competition?

No, other teams are not allowed to sit in the mediation hall during competition. Only the audience is allowed to present.

4. What will be the marking criteria for the media on plan?

20 marks have been allotted for the mediation plan that depends on clarity, structured arrangement, and accuracy of the raised issues. (Refer Rule book for further details)

5. How can participants access the media on problems?

Participants can access mediation problems through the official website of Modern Law College whose link has been provided in the flyer of the competition as well.

6. How to submit the soft copy and hard copy of media􀆟on plan?

A soft copy of the mediation plan will be submitted through e-mail ID: akshaykabra.modernlaw@gmail.com . And hard copy will be submitted by post or submit the copy in-person.

7. When to submit the mediation plan for the final round?

The mediation plan for the final round will be submitted along with the plan for the preliminary round.

8. What will be the preparation time for the final round?

Teams will come with complete preparation for both rounds, as the preliminary round will be followed by the final round on the same day.

9. Is there any extension for the submission of the mediation plan?

No, there will be no extension period for the submission of the mediation plan.

10. Is there any deadline for clarification regarding the mediation problem?

Yes, 30th December 2024 is the last date for clarification.

11. Are any electronic devices allowed to be used during mediation sessions?

No, any kind of electronic devices are not allowed during the session like mobile phones, laptops, tablets, earphones, smart watches, etc. Participants advised to use Bare Act, Journals, etc. 

12. Can you please elaborate on the process of the preliminary round and final round?

Team codes will be allotted to each team for the preliminary rounds which will be knock-out rounds. And Top 4 teams will proceed into the final round.

13. What will happen in the Private session?

In a Private session, the mediator will discuss with the parties concerning their interest and the opposite team will not be present there.

14. Will the judge act as a mediator at their discretion?

Yes, the judge will act as a mediator that will be provided by the college itself. Only the client and counsel constitute the team.

15. Are participants allowed to take notes during mediation sessions?

Yes, participants can take notes during the session to remember the important points that will lead the session.

16. Can participants ask questions to the mediator during the session?

Yes, participants can ask the question to the mediator for any advice or interpretation of any legal statutes concerning the parties.

Note: Participants are advised that the college will not offer any accommodation or lodging facilities. However, breakfast and lunch will be provided to participants during the competition.

  • FREQUENTLY ASKED QUESTIONS ON MEDIATION PROBLEM:

1. How much time would be given for the opening statement?

Each team will be given only 10 minutes for the opening statement, which includes an introduction and brief facts about the problem. This will be followed by a joint session on the interests and liabilities of the parties.

2. Do we have to submit a mediation plan for both rounds by the last date given?

Yes, parties need to submit 3 copies of the mediation plan for both rounds by the last date given as per the rulebook.

3. What are the changes in the project scope requested by the Tech giant?

It means due to unforeseen technical challenges, led to the failure of performance by InnovateTech, which resulted in changes in the delivery supply requested by TechGiant and caused them to suffer heavy losses.

4. Clarification on what kind of glitch happened from the side of Softmicro company?

A glitch in a software update caused a global IT outage that affected Softmicro systems, including Softmicro 365 services and cloud services. In verge of time bound performance of the contract they made software which contains significant bugs and errors, and its performance is far below the expected standards.

5. More details on the contract between the 2 parties regarding including the development of a new cloud-based software solution for predictive analytics, timeline for each phase of development, and payment terms.

InnovateTech is obliged to deliver software solutions for predictive analysis to TechGiant.
